Who we are?

We’re Driving Gears, Inc. (“we”, “our”, “us”) and operate under the name YouSellWeSave.

This Privacy Notice explains how and why we use your personal information when you register to our marketplace (“Marketplace”), visit our website, and use our Marketplace or any other services we offer (“Services”).

  1. Information We Collect:

      When you sign up for an YouSellWeSave account
      • personal details such as your full name;
      • contact details such as your address, email and phone number.
    2. Information we collect or generate when you get in touch:
       

If you get in touch via email or social media, we collect the following information with the purpose of responding to your questions or take necessary action:

  • the email address you use and the contents of your email, including any attachments
  • public details from your social media profile if you use these platforms to get in touch, and the contents of your message or posts to us;
  • the phone number you're calling from and information you give us during the call.
  1. Information we collect or generate when you use the Marketplace and our services, and access our Site:
     

To help improve your experience while using our Marketplace, we collect certain information:

  • details about services from us and our partners that you express interest in.
  • details about how you use our Marketplace, including the time you spend on portions of the site, how you interact with various aspects of the site (e.g. your searches), and what pages you visit (e.g. vehicles that you view);
  • performance and data usage such as searches and transactions conducted through our Marketplace.
  1. Information we collect from your device:
    • location if you’ve authorised tracking.
    • IP address and device ID, type and model.
    • operating system, Internet browser-type, Internet service provider, device settings enabled in order to analyse how our Marketplace works for you and fix any issues.
  2. Information we collect from external sources:
     

Through third-parties such as our business and affiliate partners, we might collect certain information for market research purposes and for safeguarding the operation of our Platfrom. This information includes, but is not limited to the following:

  • your use of our Marketplace, Site, Services and your use of other sites;
  • to the extent permitted by applicable law, additional information about you, such as demographic data, and fraud detection information;
  • if you choose to log in to our Marketplace through a third-party site or service (e.g. Facebook, or Google), the third-party service may send us information such as your registration and profile information from that service
  1. Legal bases for processing (for individuals located in the EEA):
    If you are an individual in the European Economic Area (EEA), we collect and process information about you only where we have legal bases for doing so under applicable European Union (EU) laws. The legal bases depend on the purpose of your interaction with YouSellWeSave. This means we collect and use your information only where:
    • we need it to offer you the Services, including to provide customer support;
    • it satisfies a legitimate interest (which is not overridden by your data protection interests), such as for research and development, to market and promote our Services and to protect our legal rights and interests;
    • you give us consent to do so for a specific purpose; or
    • we need to process your data to comply with a legal obligation.

       

If you have consented to our use of information about you for a specific purpose, you have the right to change your mind at any time, but this will not affect any processing that has already taken place. Where we are using your information because we or a third party have a legitimate interest to do so, you have the right to object to that use though, in some cases, this may mean no longer using our Marketplace or Services.

How we use information we collect

  1. We need to use your personal information for a contract we have with you, or to enter into a contract with you. We use details about you to:

    • consider your application to open an account with us;
    • provide you with our Services and access to the Marketplace in accordance with our Terms of Service. For example, we will use the information you provide to us to connect you with a potential seller and assist you in the process of buying a vehicle;
    • investigate and provide resolution to any potential complaints or issues you may have;
    • communicate with you about your YouSellWeSave account and other services you may use if you contact us, or if we need to inform you about something;
    • offer technical assistance when you submit a request or to diagnose or address technical problems in the operation of our site, Marketplace or any of our Services.
  2. We need to use your data for our legitimate interests, or those of a third party:

     

This means using data in a way that you might expect us to, for a reason which is in your and/or our (or a third-party’s) interest and which doesn’t involved overriding your privacy rights.

  1. We use your information for product development and marketing.
    We don't sell any of your information.
    We:
    • track, analyse and improve the services we give you and other customers and how you respond to ads we show. We may ask for feedback if you’ve shown interest in a service. We do this so that we can make our services better and understand how to market them;
    • tell you about products and services through the Marketplace or other channels, like social media companies, based on how you use our services and other information we hold about you. We may also exclude ads on this basis. We do this so we can make sure our marketing is useful. That includes instructing platforms to show or not show YouSellWeSave adverts to existing customers.
  2. We use your information for security and business management. We:
    • protect the rights, property or safety of us, our customers or others. For example, we use your information to detect, prevent, and/or remediate fraud, abuse, security incidents, or other potentially harmful, prohibited, or illegal activities, including enforcing or remediating any violations of our Terms of Service.
    • carry out security and maintenance checks to make sure our Marketplace, Site or other services run smoothly for you.
  3. Companies that provide services to us

We share your information with companies so they can help us provide our services (see “Who we share your data with”).

      • software companies that we use for their email services, or for processing and storing email communications;
      • other companies that make possible to provide you access to our Marketplace such as Google Maps, Google DialogFlow, and RoboNegotiator.
    2. Sellers, their agents, and third-party service providers

We might share information about you with sellers that have registered to our Marketplace, their agents and third-party service providers, who will use that information in accordance with their own privacy policies. For example, in order YouSellWeSave to assist you throughout the whole process of purchasing a car, once you have selected a a particular listing in our Marketplace, information about you may be shared with the seller of that particular car (e.g. when you use a QR Code to select or search a car in the Marketplace).

We might share information about you, including personal information, with our affiliates, who will use it in accordance with their privacy policies.

    • other platforms or apps;
    • people you’ve asked to represent you, such as attorneys.

We will keep your personal information only for as long as is necessary for the purposes set out in this Privacy Notice. We will retain and use your personal information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

We will also retain usage data for internal analysis purposes. Usage data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of our Services, or we are legally obligated to retain this data for longer time periods.

To determine how long we keep different categories of data, we consider why we hold it, how sensitive it is, how long the law states we need to keep it, and what the risks are.

  • withdraw any consent you’ve given us;
  • ask us to review a computer-made (automated) decision;
  • say no to us using your data for direct marketing and in certain other ‘legitimate interest’ circumstances.

    1. Opt out of marketing communications

You may opt out of receiving promotional communications from us by using the unsubscribe link within each email, or by contacting us as provided below to have your contact information removed from our promotional email list. Even after you opt out from receiving promotional messages from us, you will continue to receive transactional and account-related messages.

 

  1. Blocking cookies in your browser

Most browsers let you remove or reject cookies, including cookies used for interest-based advertising. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings.   1. Blocking advertising ID use in your mobile settings

Your mobile device settings may provide functionality to limit use of the advertising ID associated with your mobile device (e.g. Apple ID for Advertising or Google Advertising ID) for interest-based advertising purposes.

  1. Using privacy plug-ins or browsers

You can block sites from setting cookies for interest-based ads by using a browser with privacy features, like Brave, or installing browser plugins like Privacy Badger, Ghostery, or uBlock Origin, and configuring them to block third party cookies/trackers.

You can also use these opt-out options to limit use of your information for interest-based advertising by participating companies (but note we may work with companies that do not participate in these programs):

  1. Send "Do Not Track" Signals

Some browsers have incorporated "Do Not Track" (DNT) features that can send a signal to the websites you visit indicating you do not wish to be tracked. Because there is not yet a common understanding of how to interpret the DNT signal, our Services do not currently respond to browser DNT signals. You can use the range of other tools we provide to control data collection and use, including the ability to opt out of receiving marketing from us as described above.

While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security. We have adopted a series of technical, organisational, and physical measures to keep it secure in our data centers and it is accessible only to authorized personnel as needed to perform operations governed by this notice.

The Services are controlled and operated from the United States, however, we collect information globally and may transfer, process and store your information outside of your country of residence, to wherever we or our third-party service providers operate for the purpose of providing you our Services and access to the Marketplace. Whenever we transfer your information, we take appropriate steps to protect it.

Some of the third parties described in this Privacy Notice, which provide services to us under contract, are based in countries that may not have equivalent privacy and data protection laws to the country in which you reside. When we share information of customers in the European Economic Area, the UK, or Switzerland, we make use of the European Commission-approved standard contractual clauses for transfers to data processors.

If you feel we haven’t resolved your concerns in a satisfactory way, you may have the right to submit a complaint to the Data Protection Authority in the country where you live, where you work or where you feel your rights were infringed. If you are a California resident, there are some additional rights that may be available to you under the California Consumer Protection Act (“CCPA”). In order to protect your information from unauthorized access or deletion, we may require you to provide additional information for verification. If we cannot verify your identity, we will not provide or delete your information.

We don't sell your personal information. We do share your information with others as described under “How we share information we collect” section of this notice. We've provided more information about how you can manage your advertising and do-not-track preferences, within this notice.

We’ve also included information about how we may process your information, which includes for "business purposes" under the CCPA, such as to protect against illegal activities and offer you new Services.
